Agri-Gig is a digital marketplace that connects independent agricultural workers ("Workers") with agricultural businesses ("Farmers"). Agri-Gig is solely a software provider. We are not an employer, a staffing agency, or a farm operator. We do not direct, control, or supervise the work performed.
Workers using Agri-Gig operate as independent contractors. Workers are not employees of Agri-Gig or the Farmer unless expressly hired off-platform under a separate employment agreement. Workers are responsible for their own taxes, transportation, and appropriate work attire.
For Farmers: By hiring through Agri-Gig, you acknowledge that you are responsible for maintaining a safe work environment in accordance with the Manitoba Workplace Safety and Health Act. You are responsible for ensuring your Workers Compensation Board (WCB) coverage is active and applicable to the workers hired.
For Workers: You represent that you possess the necessary skills, certifications (including CASA/WHMIS where claimed), and licenses required to safely operate agricultural equipment. You agree to refuse any work you deem unsafe.
All payments must be processed through the Agri-Gig platform via our third-party payment processor, Stripe. When a gig is booked, funds are held in escrow and are released to the Worker upon successful completion of the gig. Agri-Gig operates on a two-sided fee structure to maintain the platform: Farmers are charged a platform fee at checkout, and a separate service fee is deducted from the Worker's final gross payout. Platform fees and Stripe processing fees are non-refundable, even in the event of a cancellation or dispute.
To protect the integrity of the platform, Escrow guarantees, and WCB compliance logs, users are strictly prohibited from taking relationships established on Agri-Gig off the platform. Sharing personal phone numbers, emails, or arranging cash/e-transfer payments outside of Agri-Gig to bypass fees will result in immediate and permanent account suspension.
If a Worker fails to appear, or if a gig is cut short, either party may initiate a Dispute through the platform. Agri-Gig retains the right, in its sole discretion, to mediate disputes, distribute escrowed funds based on hours worked, or issue full/partial refunds. Agri-Gig's mediation decisions are final.
To the maximum extent permitted by law, Agri-Gig and its founders shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to equipment damage, crop loss, personal injury, or loss of profits arising out of the use of our platform or the performance of any gig.
